What Is California’s Supplier Diversity Program

In April 2017, the CPUC established a goal of increasing LGBTBE representation in competitive contracts awarded by utilities and other public agencies across the state. To achieve this goal, the CPUC began certifying LGBTQ businesses under the same guidelines as its certified MBEs and WBEs. This means a business can become a certified LGBTQ rock quarry.

Certification includes adding gender identity and sexual orientation to the existing race, ethnicity, religion, age, disability, veteran status, citizen status, geographic location, and political affiliation requirements. The CPUC also added a requirement that LGBTQ businesses must have at least one employee identify as “non-traditional” — meaning someone who does not conform to binary notions of masculinity or femininity.

These changes mean that LGBTQ businesses that already qualify for MBE and WBE status will automatically be considered for inclusion in the state’s supplier diversity program.

But before you apply for any of these certifications, you need to understand the legal requirements and what your company needs to do to qualify for each of them. For example, if you’re applying for an MBE certification, you’ll need to show that at least 51% of your employees are members of a protected class. If you’re applying for a WBE or DBE certification, you’ll need documentation showing that your company meets specific financial criteria. You’ll also need to prove that your company is small enough to meet the size requirement for each certification.
